By installing, accessing, or using the BirdTab browser extension ("Extension"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not install or use the Extension.

2. Description of Service

BirdTab is a free browser extension that replaces your new tab page with beautiful bird images and information sourced from the Macaulay Library (Cornell Lab of Ornithology). The Extension provides:

Bird images and audio from various regions
Bird identification information
Optional features like search bar and top sites
Quiz mode for bird identification practice

3. License

BirdTab grants you a limited, non-exclusive, non-transferable, revocable license to use the Extension for personal, non-commercial purposes in accordance with these Terms.

4. User Responsibilities

You agree to:

Use the Extension only for lawful purposes
Not attempt to reverse engineer, modify, or distribute the Extension
Not use the Extension to violate any applicable laws or regulations
Not interfere with or disrupt the Extension's functionality

5. Intellectual Property

5.1 Extension

The Extension's code, design, and features are owned by BirdTab's developers. All rights not expressly granted are reserved.

5.2 Bird Content

Bird images and audio are sourced from the Macaulay Library (Cornell Lab of Ornithology) and are subject to their terms of use. Credit is provided to photographers and recordists as required.

5.3 Third-Party Content

The Extension may display content from third-party sources. Such content remains the property of its respective owners.

6. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

7. Disclaimer of Warranties

The Extension is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of content

We do not warrant that:

The Extension will be uninterrupted or error-free
Defects will be corrected
The Extension is free of viruses or harmful components

8. Limitation of Liability

To the maximum extent permitted by law, BirdTab and its developers shall not be liable for any:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Damages arising from your use or inability to use the Extension

This limitation applies regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Sentry.io: For error tracking and diagnostics
Browser APIs: For browser functionality

Your use of these services is subject to their respective terms and privacy policies.

10. Modifications

We reserve the right to modify, suspend, or discontinue the Extension at any time without notice.

We may update these Terms from time to time. Continued use of the Extension after changes constitutes acceptance of the new Terms.

11. Termination

You may terminate your use of the Extension at any time by uninstalling it. We may terminate or suspend your access to the Extension at any time, without prior notice, for any reason.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the developer resides, without regard to conflict of law principles.
